GatherWorks Incorporated provides this Privacy Policy to inform users of our policies and procedures about the collection, use, and disclosure of information received from visitors of www.GatherPlace.com and users of the web and telephone conferencing software (GatherPlace) both of which are owned by GatherWorks, Inc.
Protecting your privacy is very important to us. We respect your privacy and will not sell, rent, or share your personal information. All Products and Services for GatherPlace (as defined in our Terms and Conditions) are made available subject to this Privacy Policy. We hope the following statement will help you understand how GatherPlace collects, uses, and safeguards the personal information you provide to us on our site.
Our objective at GatherPlace is to be your software resource of choice by providing you with the information and service that are most relevant to you. To achieve this goal, we need to collect information to understand what differentiates you from each of our other unique customers. We collect this information in a few ways which are described in the section headed “Information Collection and Use.”
Our policy does not govern or control 3rd party websites to which we may provide links, because GatherPlace is not responsible, and cannot control the privacy practices or content of those sites.
Unless a legal document signed by you, or in the case of a business subscription by the company CEO, and the CEO of GatherWorks exists to take precedence, this document represents the complete and final Privacy Policy and replaces any and all prior policies. By using our website you are consenting to our collection and use of your information as described in this Privacy Policy which may be updated for any reason at any time and posted at this same location. Please check the policy frequently for updated information.
I. Security
The security of your personal information is important to us. When you enter sensitive information (such as credit card number) on our order form, our third party payment processor encrypts that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
We will disclose any known breach of the security, confidentiality, or integrity of your unencrypted electronically stored personal data to you via email or conspicuous posting on this website in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs of law enforcement or any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

II. Information Collection and Use
GatherPlace will collect your personal information if you choose to register, request information for the GatherPlace service offering, or participate in a GatherPlace session or meeting. The information we collect may include your name, email address, telephone number, company name, IP address, and information about your company as well as information about the nature of your usage of our service, including the number of meeting attendees, duration and frequency of meetings, and total number of meetings.
- a. Registration
When you register to use the GatherPlace service, software evaluation programs, email newsletters, and beta testing communities, you provide GatherPlace, and its parent company GatherWorks, with your name, email address, phone number, company name and postal addresses. While not all of this data is required for our services to function, we are better able to customize your experience if you volunteer complete and accurate information. Users who complete the registration process are given a GatherPlace ID and can take full advantage of its service. GatherPlace reserves the right to collect certain information and store it with your account.
- b. Browser
GatherPlace also automatically receives and records information in our server logs from your browser including your IP address, the page you requested, as well as CPNI, or "Customer Proprietary Network Information," which is defined in Section 222 of the Telecommunications Act of 1934 as:
- i. Information that relates to the quantity, technical configuration, type, destination, location, and amount of use of a telecommunications service subscribed to by any customer of a telecommunications provider, and that is made available to the provider by the customer solely by virtue of the provider-customer relationship; and
- ii. Information contained in the bills pertaining to telephone exchange or telephone toll service received by a customer of a provider.
- c. Cookies
In addition to the personally identifiable information that GatherPlace actively collects when you register, we also collect anonymous information passively using cookies. GatherPlace may track your visit to our site by giving you a "cookie" when you enter. Cookies are pieces of information that websites transfer to your computer's hard drive for record-keeping purposes. GatherPlace uses both “session cookies” and “persistent cookies” to make visiting our site easier and allow us to save your passwords and preferences so you can avoid having to re-enter them the next time you visit. Cookies also help us to collect anonymous click-stream data for tracking user trends and patterns.
The use of cookies is now an industry-standard, and you'll find them used on most major websites. Most browsers are initially set up to accept cookies. If you prefer, you can reset your browser either to notify you when you've received a cookie or to refuse to accept cookies. You should understand, however, that if you don’t enable cookies certain functions of our system may not work properly.
This privacy statement covers the use of cookies by http://www.GatherPlace.com only and does not cover the use of cookies by any advertisers or customer support software companies.
- d. Business Information
Business Information that is provided by meeting organizers or administrators such as meeting schedules, attendee lists, subject matter, and content of any Web presentations, live or recorded, visual or audio and any content uploaded to our servers by meeting organizers or administrators are considered confidential. We will not view Business Information except as necessary to appropriately support the service. We will use Business Information for the purpose of service capacity planning; anticipating, diagnosing, supporting or resolving any problems that might limit or disrupt the Services; and improving the quality of the Services. Any Business Information collected during the meeting is also used to facilitate debugging during development, or to debug customer escalations that are being reproduced in real time.
- e. Time-Stamps and Logs
GatherPlace routinely time-stamps and logs events (like features used, number of participants, duration of meetings, telephone numbers, email addresses, and IP addresses). This data is used for accounting/billing purposes as well as for performance tuning and optimization of the GatherPlace services.
- f. Trial Account
Any personally identifiable information you provide to GatherPlace when you sign up for a Trial account or request information over this website is maintained and accessible only by GatherPlace and its authorized partners.
- g. Meeting Participants
Furthermore, as part of the evolution of the GatherPlace service, we may collect and log information generated from the meeting participants including, but not limited to, what slides were viewed by which meeting participants during the presentation, questions and answers that are delivered to meeting presenters and participants, slide transitions, notes or annotations made by you and any other meeting participants, application sharing, posting of comments, or requests for prints or downloads of presentations. This information may also be viewed by other meeting participants. We may also collect detailed polling results identified at the user level and how each individual user voted. This information is also shared with the party who is hosting or sponsoring the meeting.
GatherPlace may also collect and record real time communication "chat" between users. As part of the GatherPlace service, a subscriber may initiate the recording function which will result in the conversation and communications of each user being recorded and logged.
GatherPlace will not disclose any information about any individual user to entities outside of those partners, except to comply with applicable law or valid legal process or when you have specifically consented to share information as part of order fulfillment or a promotion for which you have voluntarily elected to participate.
III. Access to Personally Identifiable Information
You may use our Account Settings page to correct or update your personally identifiable information or to deactivate or discontinue our service. You can also contact us by emailing our Customer Support at support@gatherplace.com or by contacting us by telephone or postal mail at the contact information listed below. We will send you an email notice confirming any changes to your account.
IV. System Events
We track certain system events for system billing information in order to understand what features are being utilized and we track certain remote system information to better understand market trends.
V. Bulletin Boards, Chat Rooms, Customer Testimonials
If you use a bulletin board or chat room on this site, or if you give permission to GatherPlace to post your quote or testimonial (print, audio, or otherwise), you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these forums. We also retain the right to terminate accounts of users/participants who use these services in a manner that is inconsistent with our Terms of Use.
VI. Agents
We use an outside credit card processing company to bill you for goods and services. This company does not retain, share, store or use personally identifiable information for any other purposes.
VII. Opt-Out
GatherPlace allows GatherPlace subscribers and trial users the ability to edit their subscriber account information at any time through the Account Management page on the website. We will honor your request to be removed from our mailing database at anytime. You may also send an email to GatherPlace Support, along with a copy of the communication you received, to help facilitate a timely and accurate removal. It is very important to us that you have a positive experience. Please email customer service with any questions or suggestions; we welcome your ideas to help us better serve you.
VIII. Fraud
Warning:We take fraud seriously. It is a crime to purchase products with a false name or with the use of an invalid credit card - one that is created for the sole purpose of purchasing items illegally or using a credit card or its information, via theft or unauthorized use. It is also illegal to misuse the charge back process to take advantage of merchants. If you are a perpetrator of fraud, be aware that we will actively pursue and prosecute fraud offenders to the fullest extent of the law.
Although most fraud offenders use free email services and false names, many are not aware that their web browser transmits a unique Internet address to us which can be used by law enforcement officials to identify and locate them. We will work with cardholders, credit card companies, and enforcement authorities to pursue fraud offenders.
We will submit all fraudulent orders sent to us to The United States Federal Bureau of Investigation (FBI) and the International Criminal Police Organization (INTERPOL) for prosecution to the fullest extent of the law.
